Terms of Service

1. Acceptance of Terms

By accessing and using the YTHCamp platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. YTHCamp is operated by MKL Studio (KvK 42128026). If you do not agree with any of these terms, you must not use this site.

2. Account Security

When creating an account on YTHCamp, you are responsible for:

  • AccuracyProviding complete and truthful information.
  • ConfidentialityProtecting your account credentials.
  • ActivityAll actions that occur under your account.
  • ReportingNotifying us of any unauthorized access.

3. User Responsibilities

As a user of YTHCamp, you agree to:

  • Use the Service in compliance with all applicable laws
  • Not attempt to circumvent security measures
  • Not upload malicious content or engage in harmful activities
  • Maintain privacy protections for participant data you collect
  • Obtain necessary consents from parents/guardians for minors

4. Subscription and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)").

  • Billing Cycle: You will be billed in advance on a recurring and periodic basis (such as monthly or annually).
  • Cancellation: You may cancel your Subscription at any time. Your access will continue until the end of your current billing period.
  • Refunds: Except when required by law, paid Subscription fees are non-refundable.

5. Camp contribution payments

Organisations may optionally collect camp contributions through the Service, including a full contribution, a deposit, or payment at a later date.

  • Payment processing: Contribution payments are processed by Stripe using Stripe Connect with direct charges. Funds are paid to your organisation's Stripe account. YTHCamp does not hold the contribution.
  • Platform fee: On each successful contribution payment, YTHCamp retains a platform fee of 1.00 in your organisation's currency (for example, €1.00). Your organisation pays Stripe's processing fees. The participant pays the contribution amount you set.
  • Your responsibilities: You are responsible for setting contribution amounts, handling refunds and chargebacks to the extent permitted by Stripe and applicable law, and meeting any tax or receipt obligations for money your organisation receives.
  • Stripe Connect onboarding: Collecting contributions may require you to complete Stripe Connect onboarding. We may disable contribution collection if onboarding is incomplete or if Stripe suspends your account.

6. Intellectual Property

The Service, including its content, features, and functionality, is owned by YTHCamp and is protected by international copyright, trademark, and other intellectual property laws.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. In no event shall YTHCamp, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
